Elite Performance Registration membership agreement IMPORTANT NOTICEThis is a contract under which you agree to become a member of Strut Studio by Strut Entertainment Group. When you sign this agreement you are entering into a legally binding contract with us. This agreement sets out your rights to use our services and the responsibilities you have as a member. These responsibilities, including payment of membership fees, do not depend on how often you use the services. Please read through this agreement fully to make sure it reflects your expectations. If you have any queries regarding the agreement, please clarify them with us before you sign.MEMBERSHIPBellydance Elite Performance TeamCONTRACT TERM13 July - 13 December, 2020MEMBERSHIP FEESTotal minimum cost of contract $800PAYMENT OF MEMBERSHIP FEES*Upfront pre-payment for contract term $800Periodic payment by direct debit $40 weekly for 20 weeks ENTITLEMENTSThis contract entitles the member to 20 x Bellydance Casual classes and 20 x Bellydance Elite Performance training sessions to be completed within the contract term. Additionally, the member is granted access to our costume library for all team performances completed during the contract term at no additional fee.ADJUSTMENTS DUE TO COVID-19 PANDEMICAt the time of commencement of this contract, stage 3 restrictions are in currently in effect in Victoria due to the COVID-19 pandemic. Therefore, our studio is prevented from being open for face to face learning for the first 6 weeks of the contract term. During the stage 3 restriction period, our commitment is to continue to provide members with the casual class component of their membership, delivered in an online format. Performance training sessions will be put on a hold during the stage 3 restriction period, with the aim for these to be completed in the studio once we are advised the studio is able to re-open. Should factors outside of our control prevent the delivery of performance training sessions in-studio during the contract term, or prevent the delivery of any other entitlements, members will be refunded this portion of the contract in the form of a credit voucher, valid for use for 12 months from the date of issue. Please also note, it is our intention to continue to provide both in studio and online attendance options for the duration of this semester, once stage 3 restrictions are lifted.CANCELLATION POLICYOnce this contract has been signed, cancellations are not permitted. Members are responsible to ensure they utilise all entitlements provided to them, including attendance at classes, training sessions and performances. Our policy states that monetary refunds will not be provided, neither full nor partial, for any costs paid in relation to this contract including membership and/or set up costs. However, as per the ADJUSTMENTS DUE TO COVID-19 PANDEMIC clause, a refund in the form of a credit voucher may be issued to you should Strut Studio be unable to provide the services as agreed to in this contract. FINANCIAL OBLIGATIONSThe total minimum cost of this contract must be paid in full by the end of the contract term. For members who have opted for periodic payment by direct debit, payments can not be terminated or suspended under any circumstances. The member is liable to pay out the full total minimum cost of the contract regardless of attendance at training or performances. Failure to do so will see the member enter into the debt recovery process, which may result in outstanding debts being forwarded to a debt collection agency. Should outstanding debts be forwarded to a debt collection agency, the member is liable for any and all debt collection fees and additional charges by the nominated agency. If you are experiencing financial hardship, please send us an email immediately to strutstudiomelb@gmail.com to see whether a special arrangement may be provided to you.SPECIAL CIRCUMSTANCESShould special circumstances such as injury or medical issues prevent a member from completing their membership package during the contract term, the member may apply for a special consideration. It is at the sole discretion of Strut Entertainment Group whether we will allow a special consideration to be provided for the member based on their circumstances. The member must advise us immediately in writing of their circumstances, via email to strutstudiomelb@gmail.com. A medical certificate should be attached where applicable. We will advise via return email whether we will allow a special consideration and provide the terms of the arrangement with the member. Normally under our special circumstances arrangement, we will allow the member to extend the date for redemption of this contract. Should the redemption date of this contract be extended for the member, we will aim to provide the member with the services agreed to in this contract at the time of redemption. However, Strut Entertainment Group will not be held responsible for any scheduling changes or class cancellations that occur between the end date of this contract and the agreed date of redemption. If at the time of redemption, the services you have signed up for under this contract are no longer available, you will be allowed to redeem the package via suitable replacement deemed by us. Please note that Strut Entertainment Group reserves the right to forfeit any services that have not been redeemed in full by the end date of this contract, as per the contract cancellation policy. Please also note, that we do not provide refunds, neither full nor partial, nor can we cancel or suspend any payment plans, under any circumstances, including illness or injury.MISSED CLASSESShould a member be unable to make it in to the studio for their classes on any given week, the member is given the opportunity to attend online instead via Zoom. If the member is unable to attend in person OR online in any week, we can offer the member a recorded copy of their class for that week in order for them to catch up on missed content. With this option now available, there are no makeup or replacement classes offered for missed classes or training sessions. All unused classes or training sessions remaining on your package at the end of the contract term are forfeited, and it is the sole responsibility of the member to ensure either all sessions or recordings are utilised prior to the end of the contract term.COSTUME HIREOur membership fee provides students with all costumes required for team performances during the term of the contract. Costumes for performances are to be picked up and returned to Strut Studio reception during business hours unless otherwise specified, and are only to be used for Strut Entertainment Group events and performances. Personal use of Costumes and Accessories is not permitted without expressed written consent. The normal Costume Hire period is 7 days from pick up, unless otherwise specified. Costumes will be placed in individual bags for the student, including any accessories that may be required to complete the costume such as swords, head pieces and jewellery. All costumes and accessories are inspected before and after the hire period. It is the member’s responsibility to inspect the costume before use and advise Strut Entertainment Group via text or email within 24 hours of pick up of any faults or damage. Our products have been worn by other members prior to your rental. Strut Entertainment Group shall not be held liable for any health-related complaints or injuries associated with products hired from our sites. Alterations or additions to Costumes are not permitted without expressed written consent from Strut Entertainment Group. Any alterations and damage beyond general wear and tear will be charged to the member. The member is responsible for the return of the Costume and Accessories. Any third party returns with missing or damaged Apparel will be charged to the member. If Apparel is lost, stolen or damaged beyond repair the member will be liable to pay for replacement of the item and any subsequent accessories to match. ATTENDANCEAll members are expected to attend a minimum of 80% of scheduled performance team training sessions. It is the member’s responsibility to catch up on any missed content either via video, by catching up with a teammate or by booking a private lesson in advance of the following class. Should attendance fall below 80%, Strut Entertainment Group reserves the right to request the member to book private lessons to catch up on missed technique and/or choreography in order to participate in upcoming performancesCHOREOGRAPHYAll choreography is strictly for the purpose of Strut Entertainment Group performances and remains the intellectual and artistic property of Strut Entertainment Group. Choreography is not to be used or adapted for other amateur or professional performances.MEDIAAll members give permission for photographs and video footage taken of them in photoshoots and at performances to be used by Strut Entertainment Group in social media posts, website and promotional / marketing activity. Photographs and videos of dancers in our costumes or at our performances can be shared on the dancer’s personal social media channels, as long as Strut Entertainment Group is acknowledged in the post. Photographs and videos of Strut Entertainment Group costumes or performances are not to be used to promote any other amateur or professional dance group or school.HEALTH ATTESTATIONMembers acknowledge that with any physical activity there are certain risks involved including the potential for physical injury and illness. Members understand that it is their responsibility to consult with a physician prior to and regarding their participation in any physical activity. Members acknowledge that they should be aware of their physical limitations and agree not to exceed them. LIABILITY WAIVERMembers agree to assume full responsibility for any risks, injuries or damage, known or unknown, which they might incur as a result of participating in participating in classes, rehearsals, performances, or activities with Strut Entertainment Group. Members knowingly, voluntarily and expressly waive any claim they may have against Strut Entertainment Group and their owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students for injury or damages they may sustain as a result of participating in classes, rehearsals, performances, or activities. Members understand that Strut Entertainment Group is an accredited and insured organisation and that in the event that they should observe any unsafe conduct or conditions before, during or after my classes, they agree to report the unsafe conduct or conditions to the owner, Kristina Finnie, or available administrators, instructors or staff members as soon as possible. Members agree to obey the class and facility rules and take full responsibility for their behaviour, in addition to any damage they may cause to the facilities utilised by Strut Entertainment Group.
